Terms of service

These Terms are issued by LifeTales Corp. (operating as Baby Yearbooks, and referred to as “Baby Yearbooks”, “we”, “us”, or “our”) and are governed by the laws of Ontario, Canada.

1. Overview

Welcome to Baby Yearbooks.

We help families create meaningful, lasting keepsakes using photos, videos, and stories. These Terms explain how our service works, what you can expect from us, and what we expect from you.

Baby Yearbooks operates its website, applications, and related services (the “Services”) to enable customers to create, store, and purchase personalized keepsakes.

By using the Services, you agree to these Terms, along with our Privacy Policy and Refund Policy. If you do not agree, you should not use the Services.

2. Your Account

You must be at least 18 years old to use the Services.

You agree to provide accurate, current, and complete information when creating an account or placing an order.

You are responsible for:

  • Maintaining the security of your account
  • All activity that occurs under your account

Accounts may not be transferred or sold.

We may suspend or restrict accounts if needed to protect our service, comply with legal requirements, or address misuse.

3. Your Content

Ownership

You retain ownership of everything you upload, including photos, videos, stories, and audio (“User Content”).

License to Baby Yearbooks

To provide the Services, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

  • Store, process, and display your content
  • Create layouts, previews, books, and QR-linked experiences
  • Provide customer support and feature functionality
  • Share content with trusted service providers (such as printing, storage, and delivery partners) solely to deliver the Services

This license ends when your content is deleted, except where retention is required for legal or operational purposes.

We do not sell your content or use it for advertising without your consent.

4. Photos of People and Consent

You are responsible for ensuring you have the right to upload any content that includes identifiable people.

By uploading such content, you confirm that:

  • You have permission from the individuals shown (or a parent/guardian for minors)
  • You have the right to share that content within the Services

We encourage you not to include sensitive identifying information (such as a child’s full name or address) alongside photos of minors.

5. Privacy and Access

Your content is private by default.

You control:

  • Who can view your content
  • Who can contribute

If you invite others to contribute, you are responsible for ensuring appropriate permissions exist.

6. Acceptable Use

You agree not to use the Services to:

  • Violate any laws
  • Infringe intellectual property rights
  • Share harmful, abusive, or inappropriate content
  • Invade another person’s privacy
  • Exploit or harm minors in any way

We do not actively monitor all content, but we may review or remove content if necessary to comply with law or protect users and our service.

7. Personal Use

Baby Yearbooks is designed for personal, family use.

The Services are not intended for general file storage, commercial use, or large-scale video hosting. If usage falls significantly outside normal personal use, we may apply reasonable limits or offer alternative options.

8. Orders, Pricing, and Billing

When you place an order, you are making an offer to purchase. We may accept or decline orders at our discretion.

Prices, promotions, and availability may change without notice.

Unless stated otherwise:

  • Prices do not include taxes, shipping, or duties
  • You are responsible for providing accurate billing information
  • You authorize us and our payment processors to charge your payment method

If you believe a charge is incorrect, contact us at help@babyyearbooks.com within 30 days.

9. Books and Printing

You are responsible for reviewing your content before submitting for printing.

Once production begins, orders cannot be changed or canceled.

We will replace books that arrive damaged or defective in accordance with our Refund Policy.

Printed results may vary slightly due to printing processes and display differences.

10. Subscription

Some features require an active subscription.

  • Bundles may include a non-renewing subscription
  • Additional subscriptions may be purchased separately
  • Subscriptions do not automatically renew unless clearly stated

After a subscription ends:

  • Your content remains stored and accessible
  • An active subscription may be required to create new content
  • You may continue editing existing content and ordering additional books

11. Storage, Videos, and Availability

We are committed to helping you preserve your content.

However, Baby Yearbooks is not a backup service. You are responsible for keeping your own copies of important content.

We cannot guarantee:

  • Uninterrupted access
  • Permanent storage under all circumstances

Videos are currently hosted within the Services. In the future, we may offer options to store or link videos through third-party platforms (such as YouTube).

We may introduce reasonable limits in the future, including:

  • Storage usage
  • Video length or size
  • Usage outside normal personal use

We will aim to communicate any changes clearly.

12. Third-Party Services

Certain features, including payments and checkout, may be provided by third parties such as Shopify.

All purchases are made with Baby Yearbooks, not those providers, and they are not responsible for transactions between you and us.

13. Intellectual Property

The Services (excluding User Content) are owned by LifeTales Corp. and protected by applicable laws.

You are granted a limited, personal, non-commercial right to use the Services. You may not copy, modify, or distribute any part of the Services without permission.

14. Feedback

If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.

15. Account Closure

We may suspend or terminate accounts if necessary to:

  • Address misuse
  • Comply with legal obligations
  • Protect our service or users

When an account is closed, associated content may be permanently deleted.

To the extent permitted by law, we are not liable for resulting loss of content.

16. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties except where required by law.

17. Limitation of Liability

To the extent permitted by law:

  • We are not liable for indirect or consequential damages
  • This includes loss of data, memories, or other intangible value

Our total liability is limited to the amount you paid us in the past 12 months.

18. Indemnification

You are responsible for your use of the Services and your content.

If a third party brings a claim arising from your use of the Services or your content, you agree to cooperate with us and be responsible for resulting costs or losses caused by your actions.

19. Resolving Issues

If you have a concern, contact us at help@babyyearbooks.com.

If a dispute cannot be resolved informally, it will be handled through binding arbitration (except for small claims).

Claims must be brought individually, not as part of a class action.

20. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Baby Yearbooks.

21. Severability

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect.

22. Assignment

We may assign these Terms as part of a business transaction. You may not assign them without our consent.

23. Governing Law

These Terms are governed by the laws of Ontario, Canada.

24. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services means you accept the updated Terms.
